Definitions

• The Company - Visions Funded Limited.
• The Site - This web site (www.givestream.com) and any of his web pages (not including sub domains).
• TOU - The following Terms Of Use.
• The Services - as described in article 3.
• The Affiliate - any NPO (Non Profit Organization) subleasing a sub-domain from the Company.

Welcome to GiveStream.com! By using the services on the site you are agreeing to the following terms of use ("TOU").

1. ACCEPTANCE OF TERMS. The Services that the Company provides to you are through, or relating to, the Site and are subject to the following Terms of Use. The Company reserves the right to update the TOU at any time without notice to you. The most current version of the TOU will be available for review through the "Terms of Use" hypertext link located at the bottom of any of our Site web pages.
2. DESCRIPTION OF SERVICES. The Company provides you with access to a variety of resources. The Services, including any updates, enhancements, new features, and the addition of any new Web properties, are subject to the TOU.
3. AFFILIATES ACTIVITIES AND WEB SITE. The Company will not be held responsible for Affiliates activities. Once you have been directed to an Affiliate's website some activities are exclusively managed by the Affiliate and the Company shall bear no responsibility whatsoever for such activity that shall take place in an Affiliates web site.
4. THIRD PARTY INFORMATION AND PUBLICATIONS. The Company is not responsible for any publication or any information, including information regarding online merchandize (price, quantity and so on) provided by any Third Party. Any such information is the sole responsibility of that Third Party to which it concerns.
5. REVIEWS, COMMENTS, COMMUNICATIONS, AND OTHER CONTENT. You may post reviews, comments, or any other content and submit suggestions, ideas, comments, questions, or other information, so long as the content is not illegal, obscene, threatening, defamatory, invasive of privacy, infringing of intellectual property rights, or otherwise injurious to third parties or objectionable and does not consist of or contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings, or any form of "spam". The Company reserves the right (but not the obligation) to remove or edit such content, but does not regularly review posted content.

   If you do post content or submit material, and unless we indicate otherwise, you grant the Company and its affiliates a nonexclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media. You grant the Company and its affiliates and sublicensees the right to use the name that you submit in connection with such content, if they choose. You represent and warrant that you own or otherwise control all of the rights to the content that you post; that the content is accurate and that use of the content you supply does not violate this Agreement and will not cause injury to any person or entity; you also agree to indemnify the Company or its affiliates for all claims resulting from content you supply. The Company has the right but not the obligation to monitor and edit or remove any activity or content. The Company takes no responsibility and assumes no liability for any content posted by you or any third party.

6. NON-COMMERCIAL USE LIMITATION. Unless otherwise specified, the Services are not designated for any type of commercial use. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products or services obtained from the Site or any of the Services.
7. PRIVACY.We do not transfer, in any way, your personal information to third without your explicit consent. We use your information only as described in the Privacy Policy. We view protection of users' privacy as a very important community principle. If you object to your information being transferred or used in this way please do not use our Services.
8. LIABILITY.In no event shall the Company be liable for any damage whatsoever resulting from any kind of use or connection with the use of any information, documents, provision of or failure to provide Services, or information available from the Services.
9. INDEMNITY.You will indemnify and hold the Company harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of this Agreement, or your violation of any law or the rights of a third party.
10. MEMBER ACCOUNT, PASSWORD, AND SECURITY. If any of the Services requires you to open an account, you must complete the registration process by providing us with current, complete and accurate information as prompted by the applicable registration form. You also will choose a password and a user name. You are entirely responsible for maintaining the confidentiality of your password and account. Furthermore, you are entirely responsible for any and all activities that occur under your account. You agree to notify the Company immediately of any unauthorized use of your account or any other breach of security. The Company will not be liable for any loss that you may incur as a result of someone else using your password or account, either with or without your knowledge. However, you could be held liable for losses incurred by the Company or another party due to someone else using your account or password. You may not use anyone else's account at any time, without the permission of the account holder.
11. NO UNLAWFUL OR PROHIBITED USE. As a condition of your use of the Services, you will not use the Services for any purpose that is unlawful or prohibited by the TOU. You may not use the Services in any manner that could damage, disable, overburden, or impair any Company server, or any network connected to any Company server, or interfere with any other party's use and enjoyment of any Services. You may not attempt to gain unauthorized access to any Services, other accounts, computer systems or networks connected to any Company server or to any of the Services, through hacking, password mining or any other means. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available through the Services.
12. LINKS TO THIRD PARTY SITES. Links, if any, to third party sites will let you leave the Site. The linked sites are not in any way under the control of the Company and the Company will not be responsible for the content of any linked site.
13. INTELLECTUAL PROPERTY. The trademarks, logos and services marks (the "Marks") displayed on the Site are the sole property of the Company. You are prohibited from using any Marks for any purpose without the written permission of the Company or such third party which may own the Marks. All information and content including any software programs available on or through the Site (the "Content") is protected by copyright. You are prohibited from modifying, copying, distributing, transmitting, displaying, publishing, selling, licensing, creating derivative works or using any Content available on or through the Site.
